      UNDER AND BY VIRTUE of a judgment and execution issued by the above named court in the above-entitled action on the 11th day of  January, in the year 2019, directed to the undersigned Sheriff from the Superior Court of Pasquotank County, I will offer for sale to the highest bidder for cash whatever right, title, and interest, the judgment debtor owns or may own in the following described real property which is subject to sale under execution.

This sale shall be held at the following location: Pasquotank County Courthouse 206 East Main Street Elizabeth City NC 27909, as designated by the Clerk of Superior Court on the 17th day of April, 2019 at 10:00 o'clock am.  This property is being sold "AS IS, WHERE IS" and said sale shall be subject to all superior liens, mortgages, easements, encumbrances, unpaid taxes and special assessments which were or became effective on the record prior to the lien of the judgment under which this sale is being held.  The judgment debtor, Charles B Giddens, claimed his/her exemptions in this real property used as a residence. If the debtor has claimed this exemption, he/she is entitled to receive and retain $35,000 ($60,000 for some debtors)  in value from the proceeds of the sale of this property. Sales for an amount less than the exemption claimed shall not be final. The sale shall be held open for ten (10) days for the filing of upset bids as required by law. No sale is final until confirmed by the Clerk of Superior Court of the issuing county.

     The execution was issued pursuant to a judgment duly recorded in the office of the Clerk of Superior Court for Pasquotank County, in the name of the judgment debtor Charles B Giddens. 

     The real property being sold is described as that certain tract(s) of land lying and being in Salem Township, Pasquotank County, North Carolina. The real property listed for taxes or special assessments for the years 2007-2017 in the name of Charles B Giddebs, the judgment debtor, and is described as follows:

 Property Map #23-R-28:  That certain lot located on Dry Point, on the East side of Hunter Street and known and numbered as Lot #28 on the plat of A. L. Aydlett, as registered in the office of the Register of Deeds of Pasquotank County in Deed Book 14, page 69 and lying between lots 27 and 29 as per said plat.  The dwelling on this property is now designated as 904 Hunter Street, Elizabeth City, N. C and fronts a distance of 40 feet on Hunter Street and extends back between parallel lines 75 feet to Butler’s Lane.  This is the same property which was conveyed to the Grantor by Deed dated June 25, 1969, from Sallie P. Barkwell, widow, and recorded in Deed Book 309, page 172 of the Pasquotank County Public Registry.  See Deed in Book 101, page 219 for further chain of title.
